What to Do After a Car Accident in Utah

The decisions you make in the next few hours can affect your case for years. Here's the order to do things in.

1

Get Medical Care

Even if you feel fine. Injuries hide.

2

Call the Police

A report protects your version of events.

3

Document the Scene

Photos, witness contacts, the other driver's info.

4

Don't Discuss Fault

Not with the other driver. Not with their insurance.

5

Talk to an Attorney

Before you accept any settlement offer.

Two Attorneys in The Top 1%

Membership in the Million Dollar Advocates Forum is limited to attorneys who have secured million-dollar verdicts or settlements — a threshold fewer than 1% of U.S. attorneys ever cross.

When an insurance company sees our name on a claim, they know they're not dealing with a firm they can lowball.

What You May Be Owed

Compensation After a Utah Car Accident

Most crash victims don't know everything they can recover under Utah law — and insurance companies aren't going to tell you.

  • Emergency room & medical bills (current & future)
  • Lost income and reduced earning capacity
  • Vehicle damage and total-loss claims
  • Physical therapy & rehabilitation
  • Pain and suffering
  • Emotional distress
  • Long-term or permanent disability
4 Years
Utah Statute of Limitations

Utah generally gives you 4 years to file a personal injury claim — but evidence disappears in weeks. Waiting can permanently weaken (or end) your case.

FAQ

Utah Car Accident Questions, Answered

How long do I have to file a car accident claim in Utah?
Utah's standard statute of limitations for personal injury is 4 years from the date of the crash. But claims against government entities — like accidents involving a city vehicle, a state road defect, or a school bus — have much shorter deadlines, sometimes just a few months. Don't assume you have time.
What if the other driver was uninsured or underinsured?
You may still have options through your own uninsured/underinsured motorist (UM/UIM) coverage. Utah law also allows certain strategies like "policy stacking" that can increase the total coverage available. We review every policy you have access to and identify all possible sources of recovery.
Should I accept the insurance company's first settlement offer?
Almost never. First offers are designed to close your file quickly and cheaply — usually before you fully understand your injuries or what your future medical care will cost. Once you sign, you almost always can't go back for more. Talk to us before you sign anything.
The crash seemed minor. Do I really need a lawyer?
Even crashes that seem minor can cause injuries that surface days or weeks later — whiplash, concussions, soft tissue damage, and back injuries are notorious for delayed symptoms. A short call costs you nothing and tells you whether involving an attorney makes sense for your specific situation.
What if I was partially at fault?
Utah is a "modified comparative fault" state. As long as you're less than 50% at fault, you can still recover compensation — though it's reduced by your percentage of fault. Insurance companies routinely try to inflate the other driver's percentage of fault to lower their payout, which is exactly why having an attorney matters.
Will I have to go to court?
Most car accident cases settle without going to trial. But we prepare every case as if it will go to trial — and that's exactly why we settle for more. Insurance companies pay attention when they know your attorney won't blink at filing a lawsuit.
What does it cost to talk to you?
Just give us a call. We'll review your situation, give you honest answers about your options, and explain how we work. We'll cover any fee questions in that first conversation so there are no surprises.
