Common Questions About Utah Personal Injury Claims

Do I actually have a case?
Every case is different. If someone else's carelessness caused your injury — a driver, a property owner, a business — you may have a claim under Utah law. The fastest way to know for sure is a short conversation with one of our attorneys. We'll tell you honestly whether we think there's a case worth pursuing.
Should I take the insurance company's first settlement offer?
Usually no. Initial settlement offers are almost always lower than what the claim is actually worth — sometimes much lower. Once you accept, you typically can't go back for more, even if your injuries get worse. Talk to an attorney before you sign anything.
What if the other driver had no insurance — or not enough?
You may still have options through your own uninsured or underinsured motorist coverage. We review every policy you have access to and identify all possible sources of compensation, including a strategy called policy stacking in some cases.
How long do I have to file a personal injury claim in Utah?
Utah's standard statute of limitations for personal injury is 4 years from the date of the accident. But claims involving government entities or certain other situations have much shorter deadlines — sometimes as little as a few months. Don't assume you have time.
Do I need a lawyer for a "minor" accident?
